Terms of Participation for OM-1 Mark II Launch Promotion

Get up to 500 GBP (600 €) cashback when buying selected OM-D Cameras and M.Zuiko Lenses

For the business relationship between OM Digital Solutions GmbH, Willy-Brandt-Strasse 23, 20457 Hamburg , registered in the commercial register of the local court of Hamburg, Germany, under number HRB 163550 and with VAT ID number DE33468753 (hereafter: "OM Digital Solutions", "we", "us") and the customer ("you") taking part in this promotion (hereafter: "Promotion"), the following Terms of Participation (hereafter: "Terms") shall apply. We do not accept any deviating conditions unless we explicitly agree to their application in writing.

1. Promotional Period
   • The Promotion applies for the products stated in clause 2, provided that they are purchased between 22.08.2024 and 15.09.2024.
   • The full cashback amount must be claimed by 29.09.2024, later claims will be rejected.
2. Eligible Products and Cashback Amount
   • This Promotion applies for the following product combinations if they are purchased in line with clause 4:

You must buy a OM SYSTEM OM-1 Mark II camera (either as a body or kit version) and additionally one of the four lenses outlined below. The products must be bought in one purchase transaction during the promotional period. For this you will receive 500 GBP (500 €) cashback, subject to these Terms.

Lenses purchased in a kit with camera are not eligible as "lens" for this Promotion and the claim will not be accepted.

3. Who can Participate
   • Only the original purchaser can take part in the Promotion.
   • Only persons who are end customers and have their habitual residence in one of the following countries are eligible to participate in the Promotion: Germany, Austria, Switzerland, Sweden, Netherlands, Denmark, Norway, Finland, Belgium, France, Luxembourg, UK, Ireland, Spain, Portugal, Czech Republic, Poland, Italy, Hungary, Slovakia ("Participating Countries"). The Promotion only applies for products specified in clause 2.
4. Eligible Products:
   • This Promotion only applies for products purchased within a Participating Country via

• the OM Digital Solutions Online Shop ( https://explore.omsystem.com/gb/en ) or
• an authorized OM Digital Solutions dealer excluding Amazon, Digitec, Galaxus and their affiliated retailers. A dealer can be found here: https://explore.omsystem.com/gb/en/stores .
  • Used and refurbished products are excluded from this Promotion.

5. How to Redeem the Cashback
   • To redeem the cashback offer, you must visit the landing page (https://my.omsystem.com/uk/p/om1-ii-launch-promotion) during the timeframe outlined of clause 1 after you have purchased an eligible product and complete the following steps:

• complete the online claim form, providing: your full name, postal address, email address, and bank account details;
• enter the details of the product purchased by you, including purchase date, serial number and retailer;
• upload and attach a scanned copy or photo of your sales receipt or invoice as proof of purchase by you of an eligible product and ensure that it shows the details outlined above; and
• declare that you agree to these Terms and have taken note of the Privacy Notice and that you allow us to send you - subject to your withdrawal at any time - our email newsletter and
• declare that the provided information is complete and correct and submit your claim

("Claim").

• After submission, you are automatically informed by email that the Claim has been received and is being processed. If you do not receive a confirmation email within twenty-four (24) hours of submitting your Claim, please contact us at support@om-digitalsolutions.com.
• Your provided email address is used to inform you about the status of the Promotion and to contact you if there are any missing or incorrect details.
• Upon receipt of your Claim, we will verify it and - subject to your compliance with these Terms - will pay the cashback sum to you in the form of a bank transfer. We endeavor to make the payment within 30 days of the date of its receipt of a valid Claim. Only one (1) payment will be issued per valid Claim. If the transfer of the cashback sum fails, e.g. due to incorrect or closed Wise/Pay-Pal account, you will be informed about this by email. In case you do not respond to this within two (2) weeks and inform us of corrected/alternative bank details, the Claim will be rejected. The cashback amount can only be transferred to a payment account located within a Participating Country (clause 3) or any other EU member state.
• We reserve the right to audit Claims to ensure compliance with these Terms and request additional information and supporting documents from you. If we do not receive those within 14 days following such request the Claim will be rejected.

6. Exclusions and Limitations

• You may only participate in this Promotion once for each eligible product (or eligible product combination) you purchase. Multiple claims for the same product (or same product combination), even if purchased multiple times, are not permitted. If you buy different products (or product combinations) that each fulfil the requirements of these Terms, you may submit your Claim separately for each product (or product combination).
• Returned products are not eligible for the Promotion. If the product is returned after the claim has been accepted and the cashback has been paid, you must refund us the cashback amount in full within 30 days of returning the product.
• This Promotion cannot be combined with other promotions and discount vouchers, is not transferable and cannot be redeemed for other benefits.
• Eligible products are subject to availability while stocks last, and we will not be liable for a dealer's failure to fulfil orders. We accept no liability in the event that products cannot be delivered within the promotional period (clause 1).
• OM Digital Solutions reserves the right to reject claims if no VAT was paid.
• OM Digital Solutions reserves the right to reject claims that are incorrect or inaccurate. Damaged, illegible or incomplete Claims and purchase receipts are not valid. OM Digital Solutions' decision regarding qualification is final and binding.

7. Data Protection
   • OM Digital Solutions is authorised to process, view, and store all data transferred as part of this Promotion according to the applicable data protection law.
   • Information about the processing of personal data in the context of participation in this Promotion can be found in the Privacy Policy ( https://my.omsystem.com/company/privacy-notice/ ). If you have an existing MyOMSYSTEM account with the same e-mail address that has been used for this Promotion, you agree that this e-mail address will be used for the purposes of fulfilling the contract with you and for sending personalized and individual information and offers for camera and audio products and any relevant services from the company (our newsletter). Where we base the processing of your personal data on your consent, we will store your data until you withdraw your consent or when it is no longer required for the original purpose.
   • You can withdraw your consent at any time free of charge by contacting us at camera.support@om-digitalsolutions.com. You can unsubscribe the newsletter also by clicking on the unsubscribe link at the end of each newsletter.
8. Miscellaneous
   • We will not be liable to you for any failure to fulfil a Claim caused by circumstances beyond either our or your reasonable control (force majeure).
   • We shall be liable to you - irrespective of the legal basis - in case of intent and gross negligence without limitation according to the statutory provisions. In the event of simple negligence, we may only be held liable for damages which are based on the breach of an essential contractual obligation (obligation which makes the proper performance of the contract possible in the first place and on the observance of which the customer may regularly rely); in this case, however, our liability shall be limited to the foreseeable, typically occurring damage. Insofar as our liability is excluded or limited, this limitation of liability shall also apply to the personal liability of its employees, legal representatives and vicarious agents.
   • The above exclusions and limitations of liability do not apply to damages resulting from injury to life, body and health or any other mandatory statutory liability.
   • OM Digital Solutions reserves the right to end the Promotion or to change the Terms of the promotion at any time without notice before you submit your Claim.

9. Governing Law

This Promotion is subject to German law. If you are a consumer, the application of mandatory legal provisions of the country of your habitual residence shall remain unaffected by the choice of German law. If the participant is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising in connection with this Promotion shall be Hamburg (Germany).
